These Terms of Service (“Terms”) govern your access to and use of the BuckWise website and application (the “Service”), operated by BuckWise (“BuckWise”, “we”, “us”, or “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference.
By registering for or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, as they may be amended from time to time in accordance with Section 16.
BuckWise is a personal finance record-keeping and analysis tool. It allows you to log expenses, income, transfers, loans, and investment activity; split expenses with other people; import statement data; and view analysis and statistics calculated from the records you provide. BuckWise does not connect to your bank accounts, does not move, hold, transmit, or have access to your money in any way, and does not act as a payment processor, money services business, or financial institution of any kind. It is solely a tool for recording and analyzing information you provide.
Nothing in the Service constitutes financial, investment, accounting, tax, or legal advice, or a recommendation to buy, sell, or hold any security or take any particular financial action.
Every figure, score, chart, and benchmark in the Service is either (a) a calculation performed directly on the data you provided, using a real, published formula that we cite in the app, or (b) explicitly labeled as BuckWise’s own display choice rather than an external standard. Generic reference benchmarks shown in the app (for example, common budgeting guidelines or published income statistics) are shown for general informational and educational purposes only and are not personalized recommendations. Market prices and portfolio figures shown in the app may be delayed, approximate, or unavailable at times. See Section 8.
You are solely responsible for your own financial decisions. Before making any financial, investment, tax, or legal decision, you should consult a qualified, licensed professional who is familiar with your individual circumstances.
You must be at least 16 years old, and the age of majority in your province or territory of residence, to create an account and use the Service. By creating an account, you represent that you meet these requirements and that you have the legal capacity to enter into these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We recommend enabling two-factor authentication (available in Settings → Security) for additional protection. We are not liable for any loss or damage arising from your failure to safeguard your account credentials.
You agree to use the Service only for its intended purpose (managing your own personal finances) and agree not to:
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including suspending or terminating their account (see Section 14).
You retain full ownership of all financial records, notes, and other content you submit to the Service (“Your Content”). You grant us a limited, non-exclusive license to store, process, and display Your Content solely as necessary to provide the Service to you. We do not claim any ownership interest in Your Content, and we do not use it for any purpose other than operating the Service, as described in our Privacy Policy. You are solely responsible for the accuracy of the information you enter or import. The Service’s analysis features can only be as accurate as the data you provide.
You can export a complete copy of Your Content, or permanently delete it, at any time from Settings → Security.
The Service displays market data (such as security prices) sourced from third-party providers. This data is provided “as is,” may be delayed, may not always be available, and may occasionally be inaccurate. We do not warrant the accuracy, completeness, or timeliness of any third-party market data, and we are not responsible for any decision made in reliance on it. The Service also uses third-party AI providers to assist in categorizing imported transactions. See our Privacy Policy for details on what information is shared with them. AI-assisted suggestions may occasionally be incorrect; you are always able to review and correct any categorization before or after it is applied.
The Service is currently provided free of charge. We reserve the right to introduce paid plans or premium features in the future. If we do, we will provide clear notice before any charge applies to your account, and continued use of any free features will not require payment.
The Service, including its software, design, text, graphics, logos, and the BuckWise name and mark (excluding Your Content), is owned by BuckWise and is protected by copyright, trademark, and other intellectual property laws. Except for the limited right to use the Service as intended, these Terms do not grant you any right, title, or interest in the Service or its underlying intellectual property.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT ANY DEFECTS WILL BE CORRECTED, OR THAT ANY CALCULATION, ANALYSIS, OR PIECE OF MARKET DATA DISPLAYED WILL BE ACCURATE OR COMPLETE. YOU USE THE SERVICE AT YOUR OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BUCKWISE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, INCLUDING ANY FINANCIAL DECISION MADE IN RELIANCE ON INFORMATION DISPLAYED BY THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY CANADIAN DOLLARS (CAD $50).
Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the fullest extent permitted by applicable law.
You agree to indemnify and hold harmless BuckWise and its operators from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of or related to your violation of these Terms, your misuse of the Service, or your violation of any right of a third party.
You may stop using the Service and permanently delete your account at any time from Settings → Security. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, or as required by law. Sections that by their nature should survive termination (including Sections 3, 10, 11, 12, 13, and 15) will continue to apply after your account is terminated.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
We may update these Terms from time to time. We will update the “Last updated” date at the top of this page, and for material changes, we will provide more prominent notice (such as an email or an in-app notification) before the change takes effect. Your continued use of the Service after a change takes effect constitutes your acceptance of the revised Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. These Terms, together with our Privacy Policy, constitute the entire agreement between you and BuckWise regarding the Service, and supersede any prior agreements.
